1. Introduction

Welcome to GrandQR. These Terms and Conditions govern your use of our website and services operated by Bogdan Sokolov (Autónomo), NIE: Z1894474S, registered in Spain.

By accessing or using GrandQR, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the service.

2. Description of Service

GrandQR provides a digital QR menu and website creation platform for restaurants, cafes, and food service establishments. Our service includes menu management, QR code generation, multilingual support with AI-powered translations, AI image optimization, table reservation systems, and analytics.

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without prior notice.

3. Account Registration

To use certain features of GrandQR, you must register an account using a valid email address. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

We use passwordless authentication via email verification codes. You are responsible for maintaining the security of your email account.

4. Subscription Plans and Payments

GrandQR offers Free, Basic, and Pro subscription plans. The Free plan is available at no cost with limited features. Paid plans (Basic and Pro) are billed monthly or yearly through our payment processor, Stripe.

Prices are displayed in Euros (EUR). By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

You may upgrade, downgrade, or cancel your subscription at any time through your dashboard. Cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods.

We reserve the right to change our prices upon 30 days' notice. Price changes will apply to billing periods starting after the notice period.

5. AI-Powered Features

GrandQR uses artificial intelligence for menu translations and image optimization. While we strive for accuracy, AI-generated translations may contain errors. You are responsible for reviewing and verifying all AI-generated content before publishing.

AI image optimization automatically processes uploaded images to improve loading performance. Original images are not stored after processing.

We do not guarantee the accuracy, completeness, or reliability of AI-generated content. You acknowledge that AI features are provided 'as is' and use them at your own discretion.

6. User Content

You retain ownership of all content you upload to GrandQR, including menu items, descriptions, images, and business information.

By uploading content, you grant GrandQR a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of providing the service.

You are solely responsible for the content you upload and must ensure it does not violate any laws or third-party rights. Prohibited content includes: illegal material, copyrighted content without authorization, misleading or fraudulent information, and content that violates health and safety regulations.

7. Acceptable Use

You agree not to use GrandQR for any unlawful purpose or in any way that could damage, disable, or impair the service.

Prohibited activities include: attempting to gain unauthorized access to other accounts or systems, using the service to distribute spam or malware, scraping or data mining, impersonating other individuals or businesses, and circumventing usage limits or security measures.

8. Intellectual Property

The GrandQR name, logo, website design, and all related intellectual property are owned by Bogdan Sokolov and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, or create derivative works based on our intellectual property without express written permission.

9. Privacy and Data Protection

Your use of GrandQR is also governed by our Privacy Policy. We comply with the General Data Protection Regulation (GDPR) and Spanish data protection laws (LOPDGDD).

We collect and process personal data necessary to provide the service, including email addresses, business information, and usage analytics. You can request access to, correction of, or deletion of your personal data at any time.

10. Limitation of Liability

GrandQR is provided 'as is' and 'as available' without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

To the maximum extent permitted by law, Bogdan Sokolov shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total liability for any claims arising from or related to the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bogdan Sokolov from any claims, damages, losses, or expenses arising from your use of the service, your content, or your violation of these Terms.

12. Service Availability

We strive to maintain high availability of our service but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We are not liable for any loss or damage resulting from service interruptions or downtime.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the service ceases immediately. We may delete your data within 30 days of termination, unless legally required to retain it.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the service.

Your continued use of GrandQR after changes become effective constitutes acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain and the European Union. Any disputes arising from these Terms or your use of GrandQR shall be subject to the exclusive jurisdiction of the courts of Spain.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
